Welcome to Rue Morgue Records. These Terms & Conditions (“Terms”) govern your access to and use of the Rue Morgue Records website, including all purchases made through our online store.

By accessing this website, creating an account or placing an order, you acknowledge that you have read, understood and agree to be bound by these Terms & Conditions.

Nothing contained within these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law (ACL) or any other applicable legislation where those rights cannot legally be excluded.

1. About Us

Rue Morgue Records is an Australian independent retailer specialising in heavy metal, hard rock, punk, extreme metal, horror soundtracks, cult cinema, music merchandise and related collectables.

Throughout these Terms:

“Rue Morgue Records”, “we”, “our” and “us” means Rue Morgue Records.

“Customer”, “you” and “your” refers to any person using our website or purchasing products from us.

2. Using Our Website

You agree to use this website only for lawful purposes.

You must not:

  • provide false or misleading information;
  • interfere with website security;
  • attempt unauthorised access to our systems;
  • upload malicious software;
  • copy or reproduce website content without written permission;
  • misuse discount codes or promotions;
  • place fraudulent or speculative orders.

We reserve the right to refuse access to our website or cancel customer accounts where misuse or unlawful activity is reasonably suspected.

3. Product Information

We make every reasonable effort to ensure product descriptions, pricing and images are accurate.

However, product information supplied by record labels, distributors and manufacturers may change without notice.

This may include:

  • release dates;
  • artwork;
  • catalogue numbers;
  • barcodes;
  • vinyl colours;
  • packaging;
  • country of manufacture;
  • bonus content;
  • included accessories.

Product photographs are provided as a guide only.

Colours and packaging may vary from the images displayed on our website.

4. Pricing

All prices are displayed in Australian Dollars (AUD).

Prices include GST where applicable.

Prices may change without notice.

If a genuine pricing error occurs, Rue Morgue Records reserves the right to cancel the affected order and issue a full refund before dispatch.

5. Orders

Submitting an order does not constitute acceptance by Rue Morgue Records.

Orders are accepted only after:

  • payment has been successfully received;
  • stock availability has been confirmed;
  • the order has been processed by our team.

We reserve the right to refuse or cancel an order where:

  • payment cannot be verified;
  • fraudulent activity is suspected;
  • stock is unavailable;
  • supplier allocations have changed;
  • an obvious pricing error has occurred.

If an order cannot be fulfilled, customers will be offered a full refund or store credit.

6. Payment

Payment must be received in full before an order is dispatched.

Accepted payment methods are displayed during checkout.

Rue Morgue Records reserves ownership of all goods until payment has been successfully completed.

7. Pre-Orders

Rue Morgue Records proudly offers a large range of pre-order titles including limited editions, retailer exclusives, imported releases and coloured vinyl variants.

By placing a pre-order, you acknowledge and agree that:

All pre-orders are final.

Pre-orders cannot be cancelled due to change of mind.

Release dates are determined by record labels and distributors and are subject to change without notice.

Manufacturing delays are common within the music industry and are outside the control of Rue Morgue Records.

Artwork, packaging, vinyl colours and product specifications may change before release.

If a supplier cancels a release or is unable to supply our allocation, customers will receive either:

  • a full refund; or
  • store credit.

8. Limited Editions

Many products sold by Rue Morgue Records are manufactured in strictly limited quantities.

Availability cannot be guaranteed until your order has been accepted.

We reserve the right to:

  • limit purchase quantities;
  • refuse bulk purchases;
  • cancel duplicate orders;
  • restrict sales where fairness requires.

9. Shipping

Orders containing multiple items are dispatched only when all items within the order are available for shipping.

If your order includes pre-order products and in-stock products, the entire order will be held until every item is available.

If you require in-stock products sooner, we recommend placing separate orders.

Separate shipping charges apply to separate orders.

Rue Morgue Records does not automatically split shipments unless agreed in writing.

Orders containing in-stock products are generally dispatched on the same business day where placed before our published dispatch cut-off time.

Same day dispatch is our normal operating standard but is not guaranteed.

Delivery timeframes are estimates provided by Australia Post or the selected courier.

Once an order has been collected by the carrier, delivery times are outside our control.

10. Delivery

Customers are responsible for ensuring that all delivery details provided during checkout are accurate and complete.

If an incorrect or incomplete delivery address is provided, Rue Morgue Records is not responsible for delays, failed deliveries or additional shipping costs.

If a parcel is returned to us because:

  • the address supplied was incorrect;
  • delivery was refused;
  • the parcel was unclaimed; or
  • the customer failed to collect the parcel,

additional postage charges may apply before the order is re-dispatched.

Original shipping costs are non-refundable unless required under Australian Consumer Law.

11. Lost or Damaged Shipments

If your order arrives damaged or appears to have been lost during transit, please contact Rue Morgue Records as soon as possible.

We may request photographs of:

  • the damaged product;
  • the shipping carton;
  • internal packaging; and
  • shipping labels.

We will work with the shipping carrier to investigate the matter and determine the appropriate resolution.

Nothing in this section limits your rights under Australian Consumer Law.

12. Returns and Australian Consumer Law

Rue Morgue Records complies with the Australian Consumer Law.

If a product is faulty, damaged, significantly different from its description or otherwise fails to meet a consumer guarantee, you may be entitled to a repair, replacement or refund as provided under Australian law.

If you believe a product is faulty, please contact us before returning the item.

We may request photographs or additional information to assist with assessing the claim.

13. Change of Mind Returns

Except where required under Australian Consumer Law, Rue Morgue Records does not offer refunds or exchanges for change of mind purchases.

This includes:

  • ordering the wrong item;
  • accidental purchases;
  • no longer wanting the product; or
  • finding the item elsewhere.

Approved exceptions remain entirely at the discretion of Rue Morgue Records.

This policy does not affect your rights under Australian Consumer Law.

14. Vinyl Records and Collectables

Vinyl records are individually manufactured products.

Minor cosmetic variations are common and do not necessarily indicate a manufacturing fault.

Examples include:

  • colour variations;
  • splatter and marble pattern differences;
  • minor sleeve corner wear;
  • small seam splits caused during freight;
  • shrink wrap imperfections;
  • paper scuffs from factory inner sleeves;
  • manufacturer-applied hype sticker placement.

These characteristics are generally regarded as normal manufacturing variations.

Similarly, collectible packaging may display minor cosmetic imperfections that do not affect the product itself.

Each claim will be assessed individually.

15. Promotions and Loyalty Program

From time to time Rue Morgue Records may offer:

  • promotional discounts;
  • coupon codes;
  • loyalty rewards;
  • clearance sales;
  • limited-time offers.

Unless specifically stated otherwise:

  • only one promotional code may be used per order;
  • promotions cannot be applied retrospectively;
  • promotions cannot be exchanged for cash;
  • promotions may exclude selected products or brands.

Participation in any loyalty or rewards program is subject to the separate Loyalty Program Terms.

Rue Morgue Records reserves the right to modify or discontinue promotional offers or loyalty programs at any time.

16. Intellectual Property

All content published on the Rue Morgue Records website, including:

  • logos;
  • branding;
  • graphics;
  • photographs;
  • product descriptions created by us;
  • website design;
  • original text; and
  • promotional material,

is owned by or licensed to Rue Morgue Records and is protected by Australian copyright and intellectual property laws.

No material may be copied, reproduced or distributed without our prior written permission.

17. Privacy

Rue Morgue Records respects your privacy.

Any personal information collected through our website is handled in accordance with our Privacy Policy.

By using our website, you consent to the collection and use of your information as described in that policy.

18. Limitation of Liability

To the fullest extent permitted by law, Rue Morgue Records excludes liability for any indirect, incidental or consequential loss arising from the use of our website or the purchase of our products.

Where liability cannot legally be excluded, our liability is limited to the remedies available under Australian Consumer Law.

19. Force Majeure

Rue Morgue Records is not responsible for delays or failures to perform our obligations where those delays arise from events beyond our reasonable control.

These events may include, but are not limited to:

  • natural disasters;
  • severe weather;
  • pandemics;
  • transport disruptions;
  • industrial action;
  • supplier failures;
  • cyber incidents;
  • government action; or
  • other unforeseen events.

Where practical, we will make reasonable efforts to minimise the impact of these events.

20. Changes to These Terms

Rue Morgue Records may amend these Terms & Conditions from time to time.

Any updated version becomes effective immediately upon publication on our website.

Continued use of the website following any update constitutes acceptance of the revised Terms.

21. Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia.

Any disputes arising from these Terms or the use of the Rue Morgue Records website shall be subject to the jurisdiction of the courts of Victoria.
